Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Servegalo platform, including the booking widget, dashboard, AI chat agent, and all related services (collectively, the "Service"), provided by Servegalo, Inc. ("Servegalo", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. Use of the Service is void where prohibited by law.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@servegalo.com of any unauthorised access. We reserve the right to suspend accounts that we reasonably believe have been compromised.

3. Subscription and Billing

• Subscriptions are billed monthly in advance. Annual plans are billed annually in advance.
• All fees are stated in USD and are exclusive of applicable taxes.
• Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
• We reserve the right to change pricing with 30 days' notice to account holders.
• No refunds are issued for partial months except where required by law.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You must not use the Service to send unsolicited messages, violate any applicable law, or infringe the rights of others.

5. SMS and Communications

By using the SMS features you represent that you have obtained all necessary consents from recipients under applicable law (including the US Telephone Consumer Protection Act). You are solely responsible for the content of messages sent through the platform and for maintaining opt-out records. Servegalo will process STOP / UNSUBSCRIBE replies automatically but you remain responsible for compliance.

6. Intellectual Property

Servegalo owns all rights in the platform, including software, designs, trademarks, and documentation. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service during your subscription. You retain all rights in content you upload or create using the Service.

7. Data

You grant Servegalo a licence to store and process your data solely to provide and improve the Service. See our Privacy Policy. Businesses handling EU/UK personal data should execute our Data Processing Agreement.

8. Third-Party Services

The Service integrates with Stripe, Twilio, AWS, and Anthropic. Your use of these integrations is subject to their respective terms. Servegalo is not responsible for the acts or omissions of third-party providers.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVEGALO'S TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM. WE EXCLUDE ALL LIABILITY FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Servegalo and its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

Either party may terminate at any time. We may suspend or terminate your account immediately for breach of these Terms. Upon termination you lose access to the Service and your data will be deleted in accordance with our data retention policy.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute shall be resolved by binding arbitration in Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. Changes

We may update these Terms at any time. Material changes will be communicated by email with at least 15 days' notice. Continued use after the effective date constitutes acceptance.
